If you have decided to pursue filing for paternity in order to establish yourself as the father and have full parental rights, there are some things you should be aware of. There are certain steps and processes that need to take place. Understanding the process can make it go smoother for you.

First off, both the State and the Mother need to be served. In most places the state, or Statutory Party as it is known, is a required party to the action. If any type of state assistance is given to the mother, the state is also a very interested party.

There has to be proof the mother was served. This comes in the form of an affidavit stating that they were by the person doing the serving. Anyone can serve the papers over 18 or the Father can choose to have the local sheriff do it. Anyone served paternity papers has a certain amount of time to respond but has to do so. These rules will vary depending on the location.

DNA testing is usually done to establish paternity but isn't necessarily required. Keep in mind, most of the times paternity suits are filed to get money out of the dad, not to give him any rights.
